Terms of Use
These Terms of Use (“Terms”) govern your use of the SynCam mobile application (the “App”) and our website (the “Site”), operated by SynCam (“we,” “us,” or “our”). By downloading, accessing, or using the App or Site, you agree to these Terms. If you do not agree, do not use SynCam.
1. The service
SynCam provides tools for synchronized photo and video capture across multiple phones, typically over a local network. Features may change over time. We may suspend, limit, or discontinue any part of the service with or without notice.
2. Eligibility
You must be able to form a binding contract in your jurisdiction to use SynCam. If you use SynCam on behalf of an organization, you represent that you have authority to bind that organization. The App is not intended for children under 13.
3. Your account and device
You are responsible for your device, network, and any permissions you grant (including camera, microphone, photo library, and local network). You are responsible for compliance with applicable laws and for the conduct of anyone who uses SynCam on your device.
4. Acceptable use
You agree not to:
- Use SynCam in any way that violates applicable law or infringes others’ rights (including privacy and intellectual property).
- Harass, harm, or record people without permission where required by law.
- Attempt to reverse engineer, interfere with, or overload the App, Site, or related systems except as permitted by law.
- Use SynCam to distribute malware or unauthorized commercial spam.
5. Content and intellectual property
You retain ownership of photos, videos, and other content you create with SynCam. You grant us a limited, worldwide, royalty-free license to use, store, and process your content only as needed to operate and improve the App for you (for example, displaying media on your device and transferring it between devices when you use session features).
SynCam, the Site, and their branding, design, and software are owned by SynCam or its licensors and are protected by intellectual property laws. Except for the limited license to use the App, these Terms do not grant you any rights in our property.
6. Third-party services
If you connect SynCam to third-party services (such as social sharing platforms), your use of those services is governed solely by your agreement with those third parties. We are not responsible for third-party services or content.
7. Disclaimers
THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SYNCAM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT SYNCHRONIZATION OR TRANSFER WILL ALWAYS BE ACCURATE OR SUCCESSFUL.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNCAM AND ITS AFFILIATES, OFFICERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP OR SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR SYNCAM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SYNCAM IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT PAID US ANYTHING.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
9. Indemnity
You will defend, indemnify, and hold harmless SynCam from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of SynCam, your content, or your violation of these Terms or applicable law.
10. Termination
You may stop using SynCam at any time. We may terminate or suspend your access if we reasonably believe you have violated these Terms or pose a risk to SynCam or others. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.
11. Governing law
These Terms are governed by the laws applicable in your primary place of residence, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country require otherwise. Courts in that jurisdiction will have exclusive jurisdiction over disputes, unless applicable law requires a different forum.
Note: You may wish to replace this section with a specific jurisdiction and venue (for example, a U.S. state or EU member state) after legal advice.
12. Changes
We may modify these Terms by posting an updated version on the Site or within the App and updating the effective date. If you continue to use SynCam after changes become effective, you accept the revised Terms.
